Sales Agreement

1.             As herein referenced, the parties to this agreement are identified as follows:

2.             This Sales Agreement is acknowledged and affirmed as being a complete description of the terms and conditions of sale concerning the following dog(s) and purchase price:

3.          SELLER guarantees, for a period of  SIX  MONTHS from date of birth, that the dog(s) herein referenced is/are free from life threatening genetic defects requiring euthanasia.  All genetic defects must be substantiated by a licensed veterinarian and confirmed by a veterinarian approved by the SELLER.  If it is determined that the dog(s) have a life threatening genetic defect, the SELLER will replace the dog(s) with a  dog(s) of the same breed once the defective dog is returned from the BUYER to the SELLER.   NO refund will be given by SELLER to BUYER.   If it is determined that the dog(s) herein referenced requires euthanasia, it must be performed by a veterinarian of the SELLER's choosing.  NO replacement will be provided from the SELLER to the BUYER if the dog is euthanized without written permission from the SELLER.

4.             SELLER warrants that, at the time of delivery,  the dog(s) herein referenced is/are in good health.   BUYER is encouraged to have the dog(s) examined by a licensed veterinarian of his/her choice within seventy-two  (72)  hours from the  time of  delivery  to verify the good health of the dog(s).  If,  during  this  72  hour period ,  the  dog(s)  is /are  found to have a life threatening condition as documented by the examining veterinarian, then upon verification of this condition to SELLER and upon return of the dog(s) by BUYER to SELLER,  SELLER agrees to supply BUYER with another dog(s) of the same species.   NO refund will be given by SELLER to BUYER.   All veterinarian fees or associated costs are to be borne by the BUYER.  

5.             In  the event BUYER fails to have the dog(s) herein referenced examined by a veterinarian within seventy-two (72) hours after delivery, then BUYER understands and agrees that the sale is one of "as  is" condition.   BUYER understands and agrees that seventy-two (72) hours after delivery of the dog to BUYER, all warranties of health, fitness, merchantability and personality trait and pet potential, whether expressed or implied by law, are hereby expressly and voluntarily waived by BUYER.

6.              The dog is sold as a PET only.  No guarantee is offered as to adult size, color, hair texture, conformation, or dropping of testicles.  BUYER holds SELLER harmless if canine registration is withdrawn or revoked by registration agency (e.g: AKC, CKC, ACA, etc.).

7.              NO guarantee is offered against hypoglycemia, cherry eye, eye entropion / ectropion, heart murmurs, loose knees or hips, dentition (over or under bite) or hernias.  NO guarantee is offered against communicable diseases such as fleas, worms, coccidia, hot spots, giardia, dermatitis,  coughs, sniffles, colds, or ear mites due to their possible recurring nature.  This guarantee is extended to the original BUYER only.   The SELLER is not responsible for problems such as landlords, allergies, incompatibilities with other pets or family members, etc.  This sale is final.  Deposits are Non-refundable.

8.             This Agreement has been read and understood by both parties hereto, and by executing the Agreement,  the parties agree that all terms and conditions contained herein are acceptable and binding.     Regardless of the conditions and circumstances surrounding the negotiation of this Sales Agreement,  BUYER and SELLER agree that the interpretation and enforcement of this Agreement shall be governed by the laws of the State of North Carolina, and any suit instituted by BUYER or SELLER to enforce any term, condition or clause of this Agreement shall be filed in the appropriate Court in the County of Forsyth, NC.
